International Players Club.
1. The International Players Club Card (hereinafter referred to as the Club Card) shall be issued by the Paragon Club Corporation Ltd. London (hereinafter referred to as PCC). The card shall remain the property of PCC. The Club Card is highly personal and not transferable to third parties. The card must be returned to PCC on request.
2. The Club Card shall entitle the holder to take advantage of the services offered by PCC. The services may be modified by PCC on account of the structures of the sport of golf and the golf course operators, and therefore may not specifically defined permanently. In particular, it shall entitle the holder to play golf on golf courses with which PCC has concluded or will conclude an agreement.
3. When using golf courses with whom PCC has an agreement, the contracting party undertakes to carefully observe and comply with the internal house rules and the golf courseregulations and pay the charges incurred there. The agreement between the golf courses and PCC can be limited in terms of any kind. PCC shall therefore not be liable to the contracting party for ending or interrupting opportunities to play.
4. The agreed annual subscription must be paid upon admission. The amount payable shall be specified by PCC.
5. If no written separate agreement exists, a fixed minimum term of the contract is one year (calendar year). Both parties may terminate the contract by giving three months’ notice to the end of a calendar year (no later than September 30.). If the contract is not terminated in due time, the contract shall be extended by 12 months. In the case of monthly subscriptions the term shall be a minimum of 12 months. This shall not affect the right of both parties to terminate the contract without observing the notice period for an important reason. An important reason for PCC to terminate the contract shall be in particular a repeated breach of the recognised rules of the golf course by the contracting party as well as the house rules and the golf course regulations on golf courses with which PCC has concluded an agreement. If the contract is terminated by PCC without observing the notice period, the contracting party shall have no right to claim back an annual subscription or partial amount based on this.
6. Claims for damages against PCC shall be excluded to the extent permitted by law. PCC shall be liable only for acts by its legal representatives and/or vicarious agents that are grossly negligent or committed intentionally. No claims for damages based on the use of golf courses and practice grounds, in particular caused by other users of the golf courses shall exist with regard to PCC.
7. The contracting party is obliged to observe the house rules and the golf course regulations as well as the recognised rules and etiquette of the game of golf. He/she shall be liable for the property damage and personal injury occurring through his/her fault that may arise in connection with the stay in the premises of the golf course and practice grounds and other club facilities used by him/her. The legal representatives of underage contracting parties shall be liable for their compliance with the general and contractual terms stated above including from the point of view of the breach of the duty to supervise.
8. PCC shall process the information by the contracting party stated overleaf, as well as the scorecards of rounds played and other information in connection with the practice of the game of golf. The contracting party hereby expressly agrees to the saving of his/her personal data.
9. In order to be valid each change to this contract, including an agreement concerning this, must be in writing.
10. If individual provisions are or become null and void, ineffective or impracticable, this shall not affect the validity and effectiveness of the remaining provisions of this contract. Rather, PCC and the contracting party agree to replace the null and void, ineffective or impracticable provisions with an effective provision that most closely approximates to the null and void, ineffective or impracticable provision and is keeping with the presumed will of the parties.
